Right to be Free to Exercise Civil Rights Under the Law
Your elderly loved one holds the right to exercise the same civil rights as other adults under the U.S. and Texas laws unless it is lawfully restricted. They have the right to use the rights free of interference, coercion, discrimination, and reprisal.
Right to Dignity and Respect
Regardless of race, religion, nationality, gender, age, disability, or marital status, your elderly loved one deserves the right to be treated with dignity and respect. They have the right to make their own choices and are free from abuse, neglect, and exploitation.
Right to Designate a Guardian or Representative
If your elderly loved one requires assistance, they have the right to designate a guardian to ensure that they are being taken care of.
Right to be Free from Physical and Mental Abuse
Physical abuse includes corporal punishment and physical and chemical restraints conducted by a second party for convenience. However, restraints are permitted only when it is authorized by a doctor, the court-appointed guardian of your loved one with an intellectual disability has given consent, or in case of an emergency. Other than that, your elderly loved one has the right to be free from physical and mental abuse.
Right to Communicate and Complain, Regarding Treatment, Care, or Services
Your elderly loved one may have trouble communicating in their native language with others or employees in their retirement community with regards to acquiring any type of treatment, care, or service. The right to communicate and complain is sometimes violated, thus, retirement communities need to ensure that they have an effective procedure for complaints and efficiently respond to them. It is against the law if your loved one complains about poor care and any of the employees retaliate in any way against your loved one.
